Terms of service

OVERVIEW

Welcome to Vantolux.

These Terms of Service are entered into between you and LIORA NOVA COMMERCE LLC, doing business as Vantolux (“Vantolux,” “we,” “us,” or “our”).

Vantolux operates this website and store, including all related information, content, features, tools, products, design services, and other services offered through the website (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy, Limited Warranty, and any other policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you access or use the Services or purchase products or services from us.

Please read these Terms carefully. They contain important information concerning your legal rights, including warranty disclaimers and limitations of liability.

By visiting, accessing, purchasing from, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you should not access or use the Services.

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or jurisdiction of residence.

To use certain features of the Services or purchase products or services, you may be required to provide information including your name, email address, billing information, shipping information, and payment information.

You represent and warrant that all information you provide is accurate, current, and complete and that you have the right to provide such information.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account.

You may not transfer, sell, assign, or license your account to another person without our authorization.

SECTION 2 — PRODUCTS AND SERVICES

We make reasonable efforts to accurately describe and display our products and services, including dimensions, specifications, colors, configurations, photographs, diagrams, and other information.

However, product appearance may vary depending on your device, screen settings, lighting conditions, manufacturing tolerances, installation environment, and other factors.

Measurements and dimensions displayed on our website are intended to assist customers with product selection. Minor variations may occur.

Product photographs, renderings, diagrams, lighting layouts, and illustrations are provided for reference and may not represent the exact appearance of a completed installation.

We reserve the right to modify product specifications, packaging, components, designs, or availability where reasonably necessary, provided that such changes do not materially reduce the product's intended functionality.

We may discontinue products or limit quantities available to any person, geographic region, or jurisdiction.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase products or services from Vantolux.

An order is not accepted until we confirm acceptance and successfully process the applicable payment.

We reserve the right to accept, reject, limit, or cancel an order where reasonably necessary, including because of product availability, suspected fraud, pricing or listing errors, payment issues, shipping restrictions, or other legitimate business reasons.

If we cancel or materially change an order after payment has been received, we will notify you using the contact information provided with the order and issue any refund required under applicable law or our policies.

Please review your order carefully before submitting it. Once an order enters processing, production, or fulfillment, we may be unable to accommodate cancellation or modification requests.

Purchases are subject to our Refund Policy.

Products may be purchased for personal, household, professional, or commercial use. Products may not be purchased for unauthorized resale, redistribution, or export without prior written authorization from Vantolux.

SECTION 4 — CUSTOM LIGHTING DESIGN SERVICES

Vantolux may offer custom lighting design services, including our Custom Garage Lighting Design service.

To provide a custom design, we may request information such as:

  • room or garage dimensions;
  • ceiling dimensions and height;
  • photographs or videos of the space;
  • desired lighting layout or style;
  • intended use of the space;
  • budget;
  • installation requirements; and
  • other project information reasonably necessary to prepare a design.

You are responsible for providing accurate measurements, photographs, specifications, and other project information.

Unless expressly agreed otherwise in writing, Vantolux does not independently inspect or measure your property.

Design Fee

Where a design service is advertised for a nominal fee, including a $1 custom design service, that amount is a fee for the design service and is not the purchase price of the lighting products shown or recommended in the design.

If stated on the applicable product or design page, the design fee may be credited toward a qualifying lighting purchase subject to the conditions stated at the time of purchase.

Design Revisions

The number of included revisions, expected delivery time, and other details of the design service will be as stated on the applicable design service page at the time of purchase.

Additional revisions or substantial changes to the original project scope may require an additional fee.

Design Accuracy

Custom lighting designs are based on the information provided by the customer.

The customer is responsible for verifying all measurements, dimensions, ceiling conditions, electrical requirements, obstructions, mounting surfaces, and other site-specific conditions before approving a design or purchasing products.

A Vantolux lighting layout is a product-layout recommendation and is not an architectural, structural, engineering, or electrical plan unless expressly stated otherwise in writing.

SECTION 5 — CUSTOM AND MADE-TO-ORDER PRODUCTS

Certain products may be customized, specially configured, cut, manufactured, assembled, or otherwise prepared specifically for a customer's project.

Before production begins, customers are responsible for reviewing and approving, where applicable:

  • product configuration;
  • dimensions;
  • quantities;
  • layout;
  • specifications;
  • color or lighting options; and
  • other project-specific details.

Once a custom or made-to-order product enters production, changes or cancellations may not be possible.

Because customized and made-to-order products are produced specifically for an individual customer or project, they may be final sale and non-returnable, except where otherwise required by applicable law or where the product is defective, damaged, or materially different from the approved order.

Please review our Refund Policy for the complete return, cancellation, and refund terms applicable to custom products.

SECTION 6 — PRICES AND BILLING

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious pricing or listing errors as permitted by applicable law.

Unless expressly stated otherwise, displayed prices do not include applicable taxes, duties, customs charges, shipping charges, or other governmental fees.

You agree to provide current, complete, and accurate billing and payment information.

You represent that you are authorized to use the payment method submitted with your order.

SECTION 7 — SHIPPING AND DELIVERY

Shipping and delivery estimates are provided for convenience and are not guaranteed.

Delivery may be affected by carrier delays, weather, customs processing, holidays, incorrect addresses, remote delivery locations, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

Please inspect packages and products promptly after delivery.

If a shipment arrives visibly damaged, contains damaged products, is missing products, or appears to have been lost in transit, contact us as soon as reasonably possible at support@vantolux.com so we can investigate the issue and determine the appropriate resolution under our Shipping Policy, Refund Policy, and applicable law.

Nothing in these Terms is intended to limit any rights relating to delivery, loss, or damaged goods that cannot legally be waived under applicable consumer protection law.

Additional shipping terms are provided in our Shipping Policy.

SECTION 8 — INSTALLATION AND ELECTRICAL SAFETY

Vantolux lighting products must be installed and used in accordance with the instructions supplied with the product and all applicable electrical, building, and safety requirements.

Before installation, you are responsible for confirming that the installation location, ceiling or mounting structure, electrical supply, clearances, and surrounding conditions are appropriate for the product.

Do not install or use a product that appears damaged, defective, or incomplete.

Installation involving hardwiring, modification of electrical circuits, or other electrical work should be performed by a qualified electrician or other appropriately licensed professional where required by applicable law.

Customers and installers are responsible for compliance with applicable local electrical codes, building codes, permit requirements, and safety regulations.

Vantolux is not responsible for damage caused by improper installation, unauthorized modification, misuse, incorrect wiring, incompatible electrical systems, failure to follow installation instructions, or installation performed contrary to applicable laws or codes, except to the extent liability cannot legally be excluded.

If you are uncertain whether a product is suitable for your installation, contact Vantolux before installation or consult an appropriately qualified professional.

SECTION 9 — LIMITED WARRANTY

Certain Vantolux lighting products are covered by a 2-Year Limited Warranty, subject to the eligibility requirements, exclusions, limitations, and claim procedures stated in the applicable Vantolux Limited Warranty.

The warranty period begins as specified in the applicable warranty policy.

Warranty coverage does not generally apply to problems caused by improper installation, misuse, abuse, unauthorized modifications, accidents, incompatible electrical systems, normal wear and tear, or other excluded conditions specified in the Limited Warranty.

The Limited Warranty does not reduce any statutory warranty or consumer rights that cannot legally be waived or limited.

Where there is a conflict between this section and the applicable Limited Warranty, the Limited Warranty will govern to the extent permitted by law.

SECTION 10 — INTELLECTUAL PROPERTY

The Services and their content, including trademarks, logos, text, photographs, graphics, videos, product designs, design layouts, and other materials, are owned by or licensed to Vantolux and are protected by applicable intellectual property laws.
